1. Agreement to Terms

These Terms of Service form a binding agreement between you and PetCare AI Pty Ltd (ABN 20 697 272 647 · ACN 697 272 647), an Australian proprietary limited company (referred to in these Terms as "PetCare AI", "the Service", "we", "us", or "our"). By accessing or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service. These Terms apply to all users, including anonymous visitors, registered users, and Pro subscribers.

All rights, obligations, and liabilities under these Terms are those of PetCare AI Pty Ltd as a separate legal entity. No director, officer, shareholder, employee, agent, or contractor of PetCare AI Pty Ltd is personally party to this agreement or personally liable under it.

2. Description of Service

PetCare AI is an AI-powered pet health triage tool that helps pet owners assess the urgency of their pet's symptoms and decide whether and how quickly to seek veterinary care. The Service provides informational assessments based on the symptoms you describe.

The Service also offers pet ownership tools including: pet profiles with medical history, public missing pet alert pages (with a shareable URL and printable poster), and a printable QR collar tag system (a unique scannable page per pet where finders can submit sightings). Some of these features publish information you provide to the public internet; see section 7 below.

3. Important Medical Disclaimer

PetCare AI is not a veterinarian and does not provide veterinary advice, diagnosis, or treatment. All content generated by the Service is for general informational purposes only and must not be relied upon as a substitute for professional veterinary consultation, diagnosis, or treatment.

Always seek the advice of a qualified and licensed veterinarian with any questions you may have regarding your pet's health. Never disregard or delay seeking professional veterinary advice because of something you have read or received from this Service.

In any situation where your pet's life may be at immediate risk, contact an emergency veterinary clinic immediately. Do not wait for or rely on an AI assessment.

The AI assessments provided are based solely on the information you provide and may be incomplete, inaccurate, or not applicable to your pet's specific situation. The Service does not account for all possible symptoms, conditions, or individual variations in animal health.

The AI model used by this Service is a large language model (LLM). LLMs can produce confident-sounding but factually incorrect output (sometimes called “hallucinations”). You must independently verify any information before acting on it.

4. User Responsibilities

You agree to:

  • Use the Service only for its intended purpose of obtaining general informational guidance about pet health and managing your own pet's profile, alerts, and collar tag
  • Not rely solely on AI assessments when making decisions about your pet's medical care
  • Always consult a licensed veterinarian for actual diagnosis and treatment
  • Provide accurate and complete information to the best of your ability
  • Only create missing pet alerts or collar tags for pets you own or are authorised to act for, and only publish contact details you have the right to share
  • Not create false, misleading, or test missing pet alerts, and close any missing report promptly once your pet is recovered
  • Not use sighting data submitted by finders for any purpose other than recovering your pet (for example, marketing, harassment, or resale)
  • Not use the Service on behalf of any third party without their consent
  • Not attempt to reverse engineer, scrape, or misuse the Service (including automated submission of fake sightings, scraping of missing-pet pages, or abuse of the address autocomplete endpoints)
  • Comply with all applicable laws and regulations in your jurisdiction

5. User Accounts

You may use certain features of the Service without an account. For full access, you must register with a valid email address and password, or via Google OAuth. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at the contact address below if you become aware of any unauthorised use of your account.

You must be at least 18 years of age to create an account and use the paid features of the Service. By creating an account, you represent that you meet this requirement.

6. Subscriptions and Payments

PetCare AI offers a free tier and a paid Pro subscription. Pro subscriptions are billed on a recurring basis — either monthly or yearly, depending on the plan you choose at checkout. Payments are processed by Stripe, Inc. and are subject to Stripe's terms of service. We do not store your payment card details.

Subscriptions automatically renew at the end of each billing period unless cancelled. You may cancel your subscription at any time through your account settings or by contacting us. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial billing periods except where required by applicable law.

UK users: Under the Consumer Contracts Regulations 2013, you have a 14-day right to cancel from the date of purchase. However, if you request and begin using Pro features within those 14 days, you acknowledge that you are waiving this statutory cancellation right. Contact us before accessing Pro features if you wish to exercise this right.

EU users: Under the EU Consumer Rights Directive (Directive 2011/83/EU), you have a 14-day right of withdrawal from the date of purchase. By subscribing and requesting immediate access to Pro features, you expressly consent to performance beginning during the withdrawal period and acknowledge that you lose the right of withdrawal once the service has been fully supplied. Contact us before accessing Pro features if you wish to exercise this right.

Canadian users: Provincial consumer protection legislation (e.g. Ontario's Consumer Protection Act, Quebec's Consumer Protection Act) may provide additional rights including, in some provinces, a statutory cooling-off period for distance contracts. These rights apply in addition to our refund policy. Quebec residents: these Terms are available in English at your explicit request — by subscribing you confirm you have expressly requested that these Terms be drafted in English (Article 55, Quebec Consumer Protection Act).

We reserve the right to change subscription pricing at any time. We will provide at least 30 days' notice of any price change to existing subscribers.

7. Public Features (Missing Alerts & Collar Tags)

When you create a missing pet alert, the alert page (including your pet's name, photo, last-seen location, and the contact details you enter) is published to a publicly accessible URL so you can share it. The page is visible to anyone with the link while the report status is “missing”.

Each pet profile also has a unique printable QR collar tag URL that, when scanned, opens a public page showing the pet's name, photo, and either (a) the contact details from an active missing alert, or (b) the emergency contact details you set on the pet profile. Anyone who scans the tag may submit a sighting, which is recorded for you (as owner) to review.

By using these features you confirm that you have the right to publish the information displayed (including your own contact details and the pet's photo), and you accept that the information will be visible to the public. We do not verify finder identities; treat any sighting as unverified information and use common sense when acting on it. You are responsible for closing a missing report promptly once the pet is recovered and for removing or updating the pet profile if your contact preferences change.

8. Pet Data and Content

You retain ownership of all pet health information and content you provide to the Service. By using the Service, you grant us a limited, non-exclusive licence to process and store your content solely for the purpose of providing and improving the Service. We will not sell your personal pet health data to third parties.

You are responsible for ensuring that any information you provide is accurate and that you have the right to provide it.

9. Third-Party Services

The Service relies on third-party providers to operate, including:

  • Anthropic, Inc. — AI language model processing. Your conversation content is transmitted to Anthropic's API to generate responses. Anthropic's usage policies apply.
  • Supabase — Database and authentication infrastructure. Your account and pet data is stored on Supabase's servers.
  • Stripe, Inc. — Payment processing for Pro subscriptions.
  • Google — OAuth sign-in, location-based clinic search via the Maps API, and address autocomplete via the Places API when you set the last-seen location on a missing pet report.

We are not responsible for the actions, content, or privacy practices of these third-party services.

10. Intellectual Property

The Service, including its design, software, and content (excluding content you provide), is owned by PetCare AI Pty Ltd and protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Service without our express written permission.

11. Limitation of Liability

In these Terms, "Released Parties" means PetCare AI Pty Ltd together with its directors, officers, shareholders, employees, contractors, agents, licensors, service providers, and affiliates.

To the maximum extent permitted by applicable law, the Released Parties shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, loss of data, loss of goodwill, business interruption, personal injury, veterinary costs, or any harm, injury, or death to your pet arising out of or in connection with your use of the Service, whether based in contract, tort (including negligence), statute, or any other legal theory, and whether or not the Released Parties have been advised of the possibility of such damages.

In no event shall the aggregate liability of PetCare AI Pty Ltd to you for all claims arising from or relating to the Service exceed the greater of (a) the total amount you paid to PetCare AI Pty Ltd in the three (3) months immediately preceding the event giving rise to the claim, or (b) USD $50 (or the equivalent in your local currency). The individual directors, officers, shareholders, employees, contractors, and agents of PetCare AI Pty Ltd shall have no personal liability to you of any kind.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for consequential or incidental damages, so some of the above limitations may not apply to you. In those cases, the liability of the Released Parties is limited to the smallest extent permitted by applicable law. In particular, nothing in these Terms excludes or limits:

  • Australia: consumer guarantees and remedies that cannot be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010).
  • United Kingdom: statutory rights under the Consumer Rights Act 2015 or liability for death or personal injury caused by negligence, fraud, or breach of any term implied by the Consumer Rights Act that cannot be excluded by law.
  • European Union: mandatory consumer rights under the Consumer Rights Directive (2011/83/EU), the Sale of Goods Directive (EU 2019/771), the Digital Content Directive (EU 2019/770), and national implementations of those Directives.
  • Canada: mandatory consumer protections under the federal Consumer Packaging and Labelling Act, the Competition Act, and applicable provincial legislation (including Ontario's Consumer Protection Act, British Columbia's Business Practices and Consumer Protection Act, and Quebec's Consumer Protection Act).
  • United States: any liability that cannot be excluded or limited under applicable US federal or state law, including state consumer protection statutes and any applicable product liability laws.

12. Indemnification

You agree to indemnify, defend, and hold harmless the Released Parties (as defined in section 10) from and against any and all claims, demands, actions, losses, damages, liabilities, judgments, fines, penalties, costs, and expenses (including reasonable legal fees and expert fees) arising out of or relating to: (a) your use of or access to the Service; (b) your breach or alleged breach of these Terms; (c) your violation of any law or third-party right (including any intellectual property or privacy right); (d) any information, content, or data you submit to the Service; or (e) any decision you make, or fail to make, regarding your pet's health in reliance on the Service.

13. Termination

We reserve the right to suspend or terminate your account at any time if you breach these Terms or engage in conduct we deem harmful to other users or the Service. Upon termination, your right to use the Service ceases immediately. You may request deletion of your account and data at any time by contacting us.

14. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Disputes shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.

This clause does not exclude any rights you hold under mandatory consumer protection law in your country of residence, including the Australian Consumer Law, the UK Consumer Rights Act 2015, the EU Consumer Rights Directive (2011/83/EU) and national implementations, Canadian provincial consumer protection legislation, or applicable US state law.

15. Changes to These Terms

We may update these Terms from time to time. We will notify registered users of material changes by email or by a notice within the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
